These Terms of Service (“Terms”) govern your access to and use of the Zubtitle website, applications, and services (collectively, the “Service”), operated by Zubtitle LLC (“Zubtitle,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you may not access or use the Service.

The Service is available only to individuals who are at least 13 years of age.

1. Accounts and Access

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

2. Use of the Service

Subject to these Terms, Zubtitle grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal, lawful purposes.

You agree not to:

Reverse engineer, decompile, or attempt to extract source code from the Service
Modify, copy, or create derivative works of the Service
Rent, resell, sublicense, or use the Service for service-bureau or timesharing purposes
Access the Service using automated means (bots, scrapers, spiders)
Interfere with or disrupt the integrity or performance of the Service
Attempt to gain unauthorized access to systems or networks connected to the Service
Use the Service for any unlawful or prohibited purpose

We may impose usage limits or suspend access to protect system integrity.

3. Subscriptions, Fees, and Payment

Certain features of the Service require payment of subscription fees.

Fees are billed in advance on a monthly or annual basis, as selected
All fees are non-refundable, except as required by law
We may change pricing with reasonable notice
Failure to pay may result in suspension or termination of access

Taxes are your responsibility unless otherwise stated.

4. Content and Intellectual Property

Our Content

All software, designs, text, graphics, and other materials provided by Zubtitle are owned by Zubtitle or its licensors and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, or exploit any part of the Service.

Your Content

You retain ownership of any content you upload or submit to the Service. By submitting content, you grant Zubtitle a limited license to host, process, and display that content solely to provide the Service.

You represent that you have all rights necessary to submit such content and that it does not infringe third-party rights.

5. Availability and Changes

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.

We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

6. Termination

You may stop using the Service at any time.

We may suspend or terminate your access:

For violation of these Terms
For non-payment
To comply with legal obligations
As part of a general shutdown of the Service

Sections that by their nature should survive termination (including IP, disclaimers, and liability limitations) will survive.

7. Warranty Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZUBTITLE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

ZUBTITLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
ZUBTITLE’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ZUBTITLE IN THE 12 MONTHS PRIOR TO THE CLAIM

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Zubtitle and its members, officers, employees, and contractors from any claims, damages, losses, and expenses (including attorneys’ fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

10. Privacy

Your use of the Service is subject to our Privacy Policy. Please review it carefully.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict-of-law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
